Montgomery County court records are available through the Public Records Online (PRO) System, one of the most advanced court records tools in Ohio. The PRO System lets you view docket entries and imaged documents for cases filed in the Dayton area courts. The Clerk of Courts is the official record keeper for the Montgomery County Municipal Court, Common Pleas Court, Domestic Relations Court, and the Second District Court of Appeals. You can search from home any time or visit the Records Section in person at the courthouse in Dayton.

Montgomery County PRO System for Court Records
The Montgomery County Clerk of Courts operates the Public Records Online (PRO) System. This is an internet-based tool that documents major events in the life of a case through an online viewable docket. What makes PRO stand out is that it also lets you see imaged documents tied to those events. Before PRO existed, you had to visit the Clerk's office, ask for file copies, pay copying charges, and return the files. Now much of that can be done from a computer.
The PRO System was built for the legal community. Judges, lawyers, probation officers, paralegals, title company officials, and court staff all use it. But it is open to everyone. Neighborhood groups use it to track foreclosure activity and follow criminal cases that affect public safety. Anyone can access it.
The system covers Traffic, Criminal, and Civil cases in Municipal Court. It also covers Criminal and Civil cases in General Division Common Pleas, Domestic Relations cases, and Court of Appeals cases in the Second District. Documents are normally available for viewing within 48 to 72 hours of filing.

Search Montgomery County Court Filings
The Montgomery County Court of Common Pleas handles felony criminal cases, civil lawsuits exceeding $15,000, and domestic relations matters. The Records Section is at Montgomery County Courts Building, 41 N. Perry Street, Room 104, Dayton, Ohio 45422. You can email them at recordssection@mcohio.org. For in-person requests, visit during business hours.
Three types of copies are available in Montgomery County. Regular copies cost $0.10 per page. Certified copies are $1.00 per page and come signed by a Deputy Clerk with a certificate stamp and embossed court seal. Authenticated copies cost $5.00 and are exemplified copies verified by a Judge. Payment may be made by cash, check, or money order. The Municipal Court also accepts credit cards.
The city of Dayton is the county seat and the main hub for court services. Residents of Kettering and Huber Heights also file cases through Montgomery County courts.
Note: Under ORC 149.43, sealed cases, juvenile files, and adoption records are not available for public viewing.
Montgomery County Municipal Court Records
The Dayton Municipal Court handles misdemeanor criminal cases, traffic violations, and civil matters up to $15,000. The court serves the Dayton area and keeps its own records accessible through the PRO System.
Montgomery County also has division courts outside Dayton. The Eastern Division Municipal Court is at 6111 Taylorsville Road, Huber Heights, Ohio 45424, phone (937) 496-7231. The Western Division is at 875 E Main St, Trotwood, OH 45426, phone (937) 687-9099. Each division handles cases from its area, but all records feed into the PRO System.
Traffic records, misdemeanor cases, and small civil claims are all searchable through the online system. For felonies and larger civil disputes, check the Common Pleas Court records.
Montgomery County Probate Court Records
The Montgomery County Probate Court maintains records of estates, guardianships, adoptions, and marriage licenses. Estate files include wills, inventories, accountings, and distribution orders. Most probate records are public. Adoption files stay sealed. Marriage license records are available for inspection and certified copies.
Court Records Access in Montgomery County
ORC 149.43 requires Montgomery County to make court records available for public inspection. The PRO System goes beyond the minimum by offering online access with actual document images. If a record request is denied, the office must cite a specific exemption. You can challenge a denial through a mandamus action.
The Ohio Rules of Superintendence set retention periods. The docket stays 25 years. Criminal files last 50 years. Civil files get two years. The Montgomery County Sheriff's Office at 345 W. The Ohio Court of Claims resolves public records disputes for a $25 filing fee. The Ohio Clerk of Courts Association helps clerks statewide follow access rules.

For a statewide criminal background check, the Ohio Bureau of Criminal Investigation charges $22 for fingerprint-based searches. The Sheriff's Office also offers local background checks for $3. Montgomery County court records only show cases filed here.
