Licking County Court Records for Newark

The Licking County Clerk of Courts keeps records for the Court of Common Pleas. Clerk Olivia Parkinson, who also serves as First Vice President of the Ohio Clerk of Courts Association, oversees the office. The Clerk files, dockets, and indexes all pleadings for civil, criminal, and domestic relations cases. Every felony arrest in Newark that leads to charges goes through this court.

Civil lawsuits over $15,000 are heard here too. So are all domestic relations cases, including divorce, dissolution, custody, and support matters. The Clerk collects court costs and fines, issues writs for summons and subpoenas, and maintains the official case docket. You can search records online by party name or case number. Copies cost $0.10 per page for regular and $1.00 for certified.

The Licking County Court of Common Pleas has general jurisdiction. It handles any case not assigned to a lower court. It also hears appeals from the municipal court and other local courts in the county. Court proceedings are open to the public unless a judge has sealed a specific case.

The Newark Municipal Court handles the cases that affect most people. Misdemeanor criminal charges, traffic tickets, and civil claims under $15,000 all go here. Small claims cases and eviction hearings also land at this court.

You can look up case information on the court's website. The system shows case numbers, parties, charges, hearing dates, and outcomes. For detailed documents or certified copies, contact the court clerk during business hours. The court follows Ohio's public records law, so most of its files are open to the public.

Newark Municipal Court is a court of record, meaning its proceedings are officially documented and can be used on appeal. If a case gets appealed from here, it moves to the Licking County Court of Common Pleas and then potentially to the Fifth District Court of Appeals.

Public Access to Newark Court Records

Ohio law says court records are public. ORC 149.43 requires that records be available for inspection to any person during regular hours. No reason needed. The clerk must give you access promptly unless a legal exemption applies.

Some things are restricted. Juvenile records, sealed cases, adoption proceedings, and certain medical files stay private. But most civil and criminal filings from Newark cases are wide open. If the clerk denies a request, they must say which exemption they are relying on. You can challenge a denial through the Ohio Court of Claims. The filing fee is $25 and the court tries mediation first.

Note: The Licking County Clerk of Courts must post the current records retention schedule where the public can see it, per ORC 149.43(B)(2).

For a statewide criminal check, the Ohio Bureau of Criminal Investigation (BCI) runs fingerprint-based background searches for $22. You need to visit a WebCheck location with photo ID. A BCI check covers Ohio. An FBI check adds nationwide results. County clerks do not handle background checks. That is BCI's job under the Ohio Attorney General.

Licking County courts follow the retention schedules in Rule 26 of the Rules of Superintendence. The docket, index, journal, and administrative journal must be kept for 25 years. Civil case files are held for two years. OVI files last 50 years. Misdemeanor criminal files stay for 50 years. Minor misdemeanor files get five years. Search warrant records last five years.
