Athens County Clerk of Courts Office

The Athens County Clerk of Courts is the official record keeper for all Court of Common Pleas cases in the county. The office handles filings for civil, criminal, and domestic relations cases. It maintains the official docket and provides public access to court records. You can email the Clerk at cmitchell@athenscountygovernment.com for records inquiries if you cannot visit in person.

The Clerk follows records retention schedules set by the Supreme Court of Ohio. Certified copies are available on request. Standard copies cost $0.10 per page. Certified copies run $1.00 per page. You can visit the courthouse during regular business hours to view any public case file at no charge. The staff can search records by party name or case number to help you find what you need.

Like all Ohio county clerks, the Athens County Clerk is an elected official serving a four-year term. The office traces its roots back to the 1802 Ohio Constitution, which provided for a Clerk in each county. Since 1851, it has been an elected position. The Ohio Clerk of Courts Association provides support and coordination for all 88 county clerks.

Athens County Common Pleas Court Records

The Athens County Court of Common Pleas has general jurisdiction over felony criminal cases, civil litigation where damages exceed $15,000, and domestic relations matters. Complete records of all case filings, hearings, and dispositions are kept by the Clerk. Public access follows Ohio's public records laws.

Case files include complaints, answers, motions, court orders, and final judgments. All of these are part of the public record unless a judge orders them sealed. Juvenile cases and adoption records are confidential. Sealed cases come off the public docket. But the majority of what gets filed in Common Pleas is open to anyone.

Athens County Municipal Court Records

The Athens Municipal Court handles misdemeanor offenses, traffic cases, and civil matters with damages up to $15,000. The court maintains records of all proceedings. Criminal dockets, traffic citations, civil case files, and judgment entries are available through the court clerk's office.

Athens County Records Under Ohio Law

Ohio Revised Code 149.43 gives any person the right to inspect public records. That includes court records in Athens County. The Clerk must make records available during business hours. No reason for the request is needed. Exemptions cover medical records, adoption files, sealed cases, DNA records, and some law enforcement files. Everything else is public.

If the Clerk wrongly denies access, you can file a mandamus action. The Ohio Court of Claims also handles public records disputes at a $25 filing cost. The court uses mediation first. Damages of up to $1,000 plus attorney's fees are possible if the public office failed to comply. The Ohio BCI handles statewide criminal background checks for $22 through WebCheck locations. County clerks only cover their own county's records.

Athens County courts follow retention schedules from the Supreme Court. Civil case files are kept for at least two years. Felony criminal files stay on record for 50 years. OVI files also last 50 years. The docket and journal are maintained for 25 years. If records exist past those periods, they remain accessible to the public. Each Clerk is required to post the current retention schedule where people can see it, per ORC 149.43(B)(2).
